Description: The Smoking, Health and Social Care (Scotland) Act 2005 came into effect in March 2006 and prohibited smoking in certain “wholly or substantially enclosed premises” including most workplaces. However, “designated rooms” in psychiatric hospitals and psychiatric units are exempt from the legislation by virtue of the Prohibition of Smoking in Certain Premises (Scotland) Regulations 2006.

The smoking rate amongst people with mental health problems is higher than that of the general population and there is also evidence to show relatively high rates of smoking amongst health professionals who work in mental health settings. Research commissioned by NHS Health Scotland reported much support for moving towards smoke-free environments within mental health services, and evidence from international literature and from case studies also suggested that this goal could be achieved.
